Surplus funds recovery

Lost a property to foreclosure or a tax sale? You may be owed money.

When a home sells at auction for more than what was owed, the extra money belongs to the former owner, or to their heirs. Counties often hold it until someone claims it. We find out if money is waiting for you and help you claim it.

What are surplus funds?

The money left over after the sale.

A property sold for unpaid taxes or a defaulted mortgage pays off the debt first. Anything left is the surplus, also called excess proceeds or overage, and by law it belongs to the former owner. In 2023 the U.S. Supreme Court confirmed in Tyler v. Hennepin County that governments can't simply keep a tax-sale surplus.

Many people never hear about it: they moved, the notice went to an old address, or the owner passed away and the family never knew.

Example
Home sold at auction for$95,000
Taxes, interest and fees owed− $18,000
Surplus owed to the owner or heirs$77,000
An example for illustration only. Every case and every state is different.
How it works

We do the searching and the paperwork.

Free check

Tell us the property or the owner's name. We search county records for funds.

Written agreement

If money is there, we explain the amount, the process and our fee in writing before you sign anything.

We file the claim

We gather the documents and prepare the claim, working with an attorney when a court filing is needed.

You get paid

The funds are released to you. Our fee comes only from money actually recovered.

Questions

Honest answers.

Is this real?

Yes. Surplus funds come from public foreclosure and tax sale records. We'll show you the county record for your case. We never ask for money up front, and we never ask for bank passwords.

Can I claim the money myself?

Often, yes. Many states let owners file a claim directly with the county or court. We help people who'd rather not spend the time on research, paperwork and follow-up, or whose case involves heirs, probate or old records.

How much is your fee?

A percentage of the amount recovered, agreed in writing before any work starts and within the limits each state allows. If nothing is recovered, you owe nothing.

The owner passed away. Can family claim it?

Often, yes. Heirs may be entitled to the funds, and we help gather what's needed: death certificates, family information and probate documents.

Which states do you cover?

We're starting with West Virginia and adding states over time. Send the property's state and county and we'll tell you whether we can help.

How long does it take?

It depends on the county and whether a court must approve the release. Some claims pay in weeks, others take several months.
